Kausik (Rejected) CRM (NDPS) 240 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Galsi Police Station Case No. 204 of 2025 dated 15th April, 2025 under Section 21(c)/25/29 of the NDPS Act.

Ms. Faria Hossain Mr. Santanu Talukdar ......for the State.

Learned advocate appearing for the petitioner submits that petitioner is in custody for 302 days and unnecessarily he is being detained without the evidence being progressed before the learned Trial Court.

Learned advocate for the State opposes the prayer for bail.

The Subject matter of the case relates to alleged recovery of more than 10,000 bottles of Phensedyl. Having considered the quantum of seizure, I am of the view that the rigors of Section 37 of the NDPS Act is attracted.

Accordingly, the prayer for bail of the petitioner in CRM (NDPS) 240 of 2026 is rejected.

However, some efforts be exerted by the prosecution for progress of the trial. Learned Special Court would take some stringent measure so that the witnesses are compelled to be present on the date so fixed.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
