After hearing learned counsel for the parties, this Court is of the view that the writ petition may be dispose of with a direction on the respondent no.4, being the Regional Transport Officer, Motor Vehicles Department, Howrah to call the petitioner for hearing and for completion of the necessary formalities for renewal of the petitioner's Certificate of Fitness in respect of the petitioner's vehicle. The concerned respondent shall intimate the petitioner within seven days from date and the petitioner shall comply with the requirements under Section 56 of the Motor Vehicles Act, 1988.

Needless to say, the petitioner's prayer for renewal of the Certificate of Fitness shall be granted if the petitioner fulfills all the statutory requirements under the Act and the Rules framed thereunder.

WPA 2410 of 2022 is disposed of in terms of the above.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertakings.
