A direction to secure expeditious disposal of an interlocutory application, filed by the petitioner/decree-holder, seeking police help, has been sought for, upon resorting to Article 227 of the Constitution of India.

In view of the nature of the order, proposed to be made, non-service of notice upon the opposite party would not cause any prejudice to the opposite party.

Service upon the opposite party, so far as present revisional application is concerned, stands dispensed with.

The prayer for police help was filed on 14.01.2019.

Taking into account the pendency of the interlocutory application, learned Judge, Second Bench, Presidency Small Causes Court at Calcutta in connection with Misc Case No. 12 of 2019 arising out of Ejectment Suit No. 145 of 2018 is directed to ensure expeditious disposal of the pending interlocutory application for police help in accordance

with the provisions of law, preferably within six months from the date of communication of this order, but without granting unnecessary adjournment, unless it is extremely unavoidable.

While endeavouring such exercise, opportunity of hearing to both the parties must be ensured. With this observation, the revisional application is thus disposed of.

There shall be no order as to costs.
