Petitioner prays for anticipatory bail.
Learned Advocate appearing for the petitioner submits that initially the victim was admitted in the hospital and thereafter discharged. Subsequently, the victim succumbed to the injuries. Learned Advocate appearing for the State draws the attention of the Court to the materials in the case diary. He submits that quite to the contrary, the victim was taken from his home by the petitioner and others, assaulted and on the victim being admitted at the hospital, expired thereat. He refers to the post-mortem report of the victim.
Post-mortem report of the victim notes a number of injuries on the body of the victim.
Opinion of the doctor conducting the post-mortem is that the death was due to the effects of the injuries noted in the report. Investigations are yet to be concluded.
Considering the gravity of the offence and the involvement of the petitioner in the incident, we are unable to grant anticipatory
bail to the petitioner.
Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
C.R.M. (A) 389 of 2024 is dismissed.
