At the time of call, no one appears for the petitioner and no accommodation is prayed for. The writ petition was taken up for consideration on 10th January, 2024 when same situation prevailed. However, respondent nos. 10, 18 and 19 as well as West Bengal Cooperative Election Commission are represented by learned advocates.

It has been submitted on behalf of the respondent nos. 10, 18 and 19 that the election for reconstitution of the Board was held on 11th August, 2018 and based on which, Board was constituted and the tenure of the Board expired after five years in 2023. Therefore, according to those respondents, the writ petition has become infructuous, since, the Special Officer has already been appointed after expiry of the Board.

In view of the aforesaid submission made

on behalf of the respondent nos. 10, 18 and 19, the writ petition stands dismissed as infructuous. Interim order, if any, stands vacated.

Urgent photostat certified copy of this order, if applied for, be given to the learned Advocates for the parties on the usual undertakings.
