The petitioner is in custody for more than four months. Learned counsel for the petitioner submits that there is no evidence which transpired during investigation suggesting nexus of the petitioner with the alleged crime. Charge sheet has been submitted. He has been falsely implicated. His further detention is not required. Opposing the prayer, learned counsel for the State produces the Case Diary and submits that the petitioner is the principal accused who has been operating from Beur Correctional Home, Patna where he is presently lodged. His voice sample recorded from the mobile phone used by him has matched upon CFSL examination. He is the kingpin of a team of shooters and has criminal antecedents throughout the country. Learned counsel draws the attention of this Court to an order dated 7th March, 2025 of this Court in CRM (DB) 113 of 2025 turning down the bail prayer of a co-accused standing on a better footing than the petitioner.

I have considered the material on record.

The petitioner appears to be the principal accused and material available in the Case Diary indicates his direct and active involvement in the offence alleged. Charge sheet has been submitted and charges framed.

Considering the incriminating material available against the petitioner in the Case Diary as well as nature and gravity of the offence including the criminal antecedent of the petitioner, the prayer for bail is rejected at this stage.

Case Diary be returned.

The application for bail is disposed of.
