Learned advocate appearing on behalf of the petitioner has submitted that the learned Judge fixed the date for S/R and A/D in spite of service of notice effected upon the husband/opposite party.

Considering the facts and circumstances, I do not find any reason to ask the petitioner to serve notice upon the opposite party. Thus, service of notice upon the opposite party stands dispensed with.

Accordingly, the learned Additional District Judge, 2nd Court, Bongaon, North 24-Parganas, is requested to dispose of the application under Section 24 of the Hindu Marriage Act, as expeditiously as possible,

after being satisfied about service of notice upon the opposite party/husband.

With the aforesaid observation, the revisional application, being CO 359 of 2023, stands disposed of. Learned advocate appearing on behalf of the petitioner is at liberty to bring this order to the notice of the learned Additional District Judge, 2nd Court, Bongaon, North 24-Parganas, forthwith.

All parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be given to the parties, upon compliance of necessary formalities.
