Petitioner claims that a portion of his property has been grabbed by respondent no.6 and respondent no.7. Record reflects that Title Suit no. 285/2015 was filed by the respondent no.5 wherein the petitioner is a party. Mr. Sengupta, learned advocate appearing for the State submits that at the relevant point of time when the information was furnished on or about the 2nd week of January, 2024, police authorities kept a strict vigil. However, the issue related to a long standing land dispute and as such the police authorities were unable to take appropriate steps in respect of the nature of the dispute and only restricted them to prevent any breach of the peace and/or any tranquility.

In view of the Civil Court already in seisin of the issue, petitioner would take out an appropriate application, if they are prevented from entering the property. In case a direction is passed and police

authorities are directed to act in a particular manner, police authorities would respect, obey and implement such order.

With the aforesaid observations WPA 2487 of 2024 is disposed of.
