Banerjee) Syed Nurul Arefin Syed Moyeenul Arefin Mr. Sanju Agarwal ...for the petitioners This application under Article 227 of the Constitution of India is at the instance of the respondent in Title Appeal No. 1322 of 2014 praying for a direction upon the learned Additional District Judge, 5th Court at Howrah to dispose of the title appeal expeditiously.

It appears from the order dated May 17, 2023 that a date was fixed for hearing of the petition under Order 1 Rule 10(2) of the Code of Civil Procedure. Learned advocate for the petitioners submits that the said application has already been allowed. He further submits that the appeal is otherwise ready for hearing.

In view of the orders sought and proposed to be passed this Court finds that there is no necessity to direct issuance of any notice upon the opposite

parties. However, the learned advocate for the petitioners shall be obliged to forward a copy of the application along with a copy of this order upon the opposite parties or upon their learned advocate representing them in the learned appellate Court. In the light of the said submissions, CO 389 of 2025 is disposed of by requesting the learned Additional District Judge, 5th Court at Howrah to dispose of the Title Appeal No. 1322 of 2014 as expeditiously as possible without granting any unnecessary adjournment to either of the parties.
