1. Learned counsel on behalf of the petitioner has submitted that this revisional application was filed being aggrieved by the order of refusal of an application under Order 7 Rule 11 of the Code of Civil Procedure passed by the learned Civil Judge (Senior Division), 6th Court, Alipore, South 24Parganas in connection with Title Suit No.544 of 2019.

2. It is further submitted that in course of pending of this revisional application plaintiff filed amendment application which was allowed and that was assailed before this Court in CO No. 52 of 2022 which was also refused.

Thereafter, defendant/petitioner herein filed additional written statement in the suit.

3. It is submitted on behalf of the defendant/petitioner herein that the instant revisional application has become infructuous.

4. Regard being had to the above, the revisional application stands dismissed being infructuous.

5. Interim order, if any, stands vacated.

6. Connected applications, if any, also stand disposed of.

7. Urgent photostat certified copy of the order, if applied for, be given to the parties on usual undertakings.

8. All parties shall act on the server copies of this order duly downloaded from the official website of this Court.
