Kapas ...For the State Leave is granted to the petitioner to add the Director of Public Instruction as a respondent in this writ petition. The grievance of the petitioner relates to his pay protection and service continuation. It appears that the petitioner is presently working as Library Assistant in Bankim Sardar College, South 24 Parganas. He submitted a representation before the Director of Public Instruction for his pay protection and continuation of service.
The Director of Public Instruction, West Bengal by a letter dated September 28, 2016 requested the College to submit a report.
It appears that despite such communication being made, no response was received from the end of the College.
I do not see any justification to keep the writ petition pending. Accordingly, this writ petition is disposed of with a direction upon the Principal, Bankim
Sardar College to provide the necessary information in the form of a report before the Director of Public Instruction, West Bengal within a period of two months from date. After such a report is provided, the Director of Public Instruction will consider the grievance of the petitioner on merit within a period of four weeks thereof. The Director of Public Instruction, West Bengal will be at liberty to hear the petitioner and the College before arriving at his decision.
The Director of Public Instruction will communicate his decision to the petitioner within two weeks thereafter. With the aforesaid directions, WPA 1373 of 2018 is disposed of.
Let urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance with all the necessary formalities.
