43.
Ct.No.28 as (Rejected) C.R.M. (DB) 455 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Katwa P.S. Case No.826 of 2022 dated 28.10.2022 under Section 6 of the POCSO Act read with Sections 8/12 of the POCSO Act. In the matter of : Sankar Singha @ Shankar Singha. ... Petitioner.
Mr. Kalidas Saha.
...for the Petitioner.
Mr. Avishek Sinha.
...for the State.
Petitioner is in custody for 100 days. He submits he has been falsely implicated. He prays for bail.
Learned Advocate for the State opposes the bail prayer. We have considered the materials on record. Petitioner was a private tutor of the minor. He subjected the minor to sexual assault. Minor is yet to be examined.
Under such circumstances, we are not inclined to grant bail to the petitioner at this stage.
Accordingly, the prayer for bail of the petitioner is rejected.
