Sr. St. Counsel, Ms. Ipsita Banerjee ...for the State The petitioner is aggrieved that notwithstanding complaint dated January 27, 2022, addressed to the Tehatta Police Station, the Superintendent of Police and the SDPO, Krishnanagar, Nadia, steps have not been taken to protect the petitioner's occupation of a particular property wherein he is running his chamber. The petitioner is a practising advocate.

Counsel for the State submits that there is a dispute with regard to ownership of the property, where the petitioner claims to have his chamber. There are rival claims between the petitioner and the private respondents on the said property.

This Court is of the view that the dispute purely civil in nature, and the title should be

decided by the appropriate Civil Court, as and when approached by the parties.

The Tehatta Police Station has indeed taken steps and drawn up proceedings under Sections 107 and 116 of the Cr. P.C.

In that view of the matter, the writ petition is disposed of, directing the Officer-in-Charge, Tehatta Police Station to continue to maintain vigil over the said premises, and to ensure that there is absolutely no breach of peace.

There shall be no order as to costs.
