Learned advocate appearing for the petitioner submits that the petitioner was falsely implicated. The chemical examination report does not suggest any narcotic. Learned advocate appearing for the State submits that the chemical composition states that narcotic was seized. Considering the fact that narcotic of commercial quantity was seized from the possession of the petitioner, we are of the view that the petitioner is unable to overcome the restrictions under Section 37 of the N.D.P.S Act, 1985.

Consequently, we are not inclined to grant bail to the petitioner.

Prayer for bail of the petitioner is rejected. CRM (NDPS) 189 of 2022 is dismissed.
