Moupiya Karmakar v. State Of West Bengal And ORS.
22-09-2022 Item No.4 Subrata Bhattacharyya
IN THE HIGH COURT AT CALCUTTA
Constitutional Writ Jurisdiction Appellate Side WPA No.2433 of 2022 Moupiya Karmakar -vsThe State of West Bengal & Ors.
Ms. Manali Biswas Mr. Suparno Ghosh ...for the petitioner Mr. Swapan Banerjee Mr. Sougata Mitra ...for the State Md. Sarwar Jahan Sk. Nayeemul Haque ...for the school Learned counsel for the petitioner hands over a cheque of Rs.1,04,639/- to learned advocate for the seventh respondent - the teacher in charge of Mirzapur Dr. Jatindra Narayan Smriti Balilka Vidyalaya (Higher Secondary). Learned counsel for the seventh respondent acknowledges receipt of the cheque.
It was observed by the last order dated September 19, 2022 that the school authority would have no objection provided the petitioner paid Rs.1,04,639/- which was due and payable by her.
Since the petitioner has paid the amount to the school authority, I feel that the writ petition should be disposed of by the following order.
The seventh respondent is directed to issue no objection to the petitioner and proceed further in accordance with law for the purpose of her transfer. It is expected that the school authority would cooperate with the petitioner relating to her transfer.
It is made clear that the petitioner is not responsible as to the distribution of the dresses of the students of the school.
With the aforesaid, WPA No.2433l of 2022 stands disposed of. No order as to costs.
