Learned senior advocate appearing for the petitioner submits that the petitioner is in custody for 116 days and charge-sheet has already been submitted before the jurisdictional court.

Learned advocate appearing for the State opposes the prayer for bail and draws the attention of the Court to the

statement of the witnesses including that of the victim under Section 183 of the BNSS.

Learned advocate appearing for the de facto complainant opposes the prayer for bail and submits that the accused on repeated occasion caused inconvenience and inappropriately touched the victim and lastly she could gather the courage to divulge the incident. Victim was under mental trauma for a considerable period of time and is still suffering from mental depression.

I have taken into account the period of detention of the present petitioner as well as the agony expressed on behalf of the victim. Having considered the overall view of the circumstances, I am of the opinion that further detention of the present petitioner in connection with the instant case is unwarranted. As such, the prayer for bail of the petitioner is allowed.

Accordingly, the petitioner viz., Biplab @ Biplab Mandal shall be released on bail upon furnishing bond of Rs.20,000/-, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Judge, Special Court under the POCSO Act, Barrackpore, North 24-Parganas.

If on bail, the petitioner shall be physically present on each and every date so fixed by the learned Special Court and shall not enter the jurisdiction of Rahara Police Station. Additionally, the petitioner shall furnish his address where he would be staying and report to the Officer-in-

Charge of the said jurisdictional police station once a fortnight till the same is modified by the learned Trial Court. The application for bail, being CRM (R) 17 of 2026, is, thus, disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
