CAN No. 1 of 2025 The applicants who are the wife and the sons of the writ petitioners seek to be substituted in place of the writ petitioner in view of expiry of the writ petitioner during pendency of the writ petition.

The application has been filed within the statutory period of time.

The application being CAN No. 1 of 2025 is allowed. The applicants be substituted in place of the writ petitioner.

Re : WPA No. 2508 of 2024

Learned counsel for the petitioners submits that the original writ petitioner was initially a member of the Haldia Advocates' Bar Association and subsequently formed a new association under the provision of the West Bengal Societies Registration Act, 1961 which is pending registration. The original petitioner alleged that he was not allotted a room for his association and was restrained by the members of Haldia Civil Bar Association from entering the Court premises and continuing his profession.

The original writ petitioner has unfortunately expired during pendency of the writ petition. All his heirs are not practising advocates. The prayers in the writ petition do not apply to the present writ petitioners. In view of the above, this Court is inclined to hold that no cause of action survives in the writ petition after demise of the erstwhile writ petitioner. The writ petition is devoid of any merit and no relief can be granted to the present petitioners herein.

The writ petition is dismissed.

There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.

Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
