During the course of submissions, learned senior counsel for the petitioner seeks permission to withdraw the present petition with liberty to file the appropriate petition before the before the learned Session Judge in accordance with the law keeping all the contentions are left open.

It is made clear that this Court has not gone into the merits of the case and no expression made herein shall tantamount to be an expression on the merits of the case. 4.

Petition is dismissed of as withdrawn.

The time consumed in filing this revision petition shall be taken into account while computing period of limitation to be filed before the learned Additional Sessions Judge. In case the revision petition is filed within four weeks of the order of this Court, there shall be stay of the warrant of arrest for another two weeks. However, the learned Additional Sessions Judge shall decide the prayer for interim relief independently without being influenced by the State granted by this Court.
