The writ petitioner is aggrieved by the fact that Magrahat Police Station, DDH Police District, South 24 Parganas has not taken any steps, with regard to his complaint dated 28th January, 2022 against the private respondent.

The petitioner claims that he has purchased certain properties from the private respondent and had agreed to allow him to run a School in some portions of the aforesaid property building.

It is submitted that the petitioner now requires the property, and the private respondent is not willing to vacate the same.

A notice to quit has also been issued.

The Officer-in-charge, Magrahat Police Station, has submitted a report in the form of instructions to the learned State Advocate dated 6th April, 2022. The same is taken on record.

It appears from the said report, as also annexures to the writ petition, that the matter is

purely civil in nature, and there is no element of criminality involved. It further appears from the said, report that the police have no role to play whatsoever, in the matter.

In that view of the matter, the instant writ petition shall stand disposed of without any order. However, the Officer-in-charge, Magrahat Police Station shall ensure that there is no breach of peace in the area.

There will be no order as to costs.
