Learned Counsel appearing for the petitioner submits that the petitioner is a retired teacher of Scottish Church Collegiate School and the State has denied the petitioner from pension. The petitioner has made a representation before the Commissioner of School Education, Government of West Bengal, being the respondent no.3 in the instant application but such application made on 4th January, 2021 has not been considered till date.

No one appears on behalf of the State when the matter is called up for hearing. There was no representation from the State even on 3rd March, 2021 when the matter was taken up.

Learned Counsel Mr. Baid appears for the School.

Heard both the parties.

As the representation dated 4th January, 2021 has not been considered by the Commissioner of School

Education, Government of West Bengal, The Commissioner of School Education being the respondent no.3 in the instant application is requested to consider the representation of the petitioner. The writ petitioner is directed to serve a copy of this order along with a copy of the writ petition to the Commissioner of School Education, Government of West Bengal within seven days.

The Commissioner of School Education, Government of West Bengal is requested to give an opportunity of hearing to the petitioner and to pass a reasoned order within twelve weeks from today. The Commissioner of School Education, Government of West Bengal is also requested to communicate the reasoned order to the petitioner at an earliest.

The writ petition being WPA 3019 of 2021 is accordingly disposed of.

There will be no order as to costs.

Since no affidavit have been invited, the allegations made in the writ petition are deemed to have been denied.

Urgent certified website copy of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
