Learned counsel for the Distribution Licensee submits that, pursuant to the previous order of this court, the Distribution Licensee has already raised a quotation, upon the petitioner having applied for a commercial connection at the premises.
Subject to compliance of all formalities, it is submitted that there is no difficulty on the part of the Distribution Licensee to supply such electricity connection at the existing meter board position. Accordingly, WPA 2451 of 2022 is disposed of by directing the CESC Limited to give electric connection to the petitioner positively within a fortnight from
compliance of all formalities or from this day, whichever is later.
If any obstruction is faced by the CESC personnel while giving such connection, it will be open to the personnel to approach respondent no.4, the Officer-inCharge of the Amherst Street Police Station. If so approached, the Officer-in-Charge shall provide adequate police assistance to the CESC personnel at the cost of the petitioner for the above purpose. It is made clear that in the event the petitioner faces any hindrance from the private respondent in having access to the existing meter board position or providing such access to the CESC personnel at later points of time, the petitioner will be at liberty to approach the Civil Court for appropriate relief(s) upon prior notice to the private respondent/plaintiff.
The supply of electricity shall not create any special equity or right in favour of the petitioner.
There will be no order as to costs.
Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
