The learned counsel for the petitioners has submitted that instead of review, an appeal would be appropriate relief against the order dated 10.01.2024 passed, inter alia, in WPA 1712 of 2022 (Dr. Prasenjit Kabiraj Vs. State of West Bengal and others).

It further appears to this Court that the grounds urged in the review may not be sustainable under Order 47 of the Code. Time spent in the instant review application may be considered as a time spent mistakenly in judicial proceedings under Section 14 of the Limitation Act.

With the aforesaid observations, the instant review petition is dismissed as withdrawn.
