The writ petition has been filed seeking cancellation and set aside of the order dated 17.03.2020 by the Joint Secretary, Government of West Bengal, C.D.P.O. By the said order the Joint Secretary rejected the case of the petitioner for benefit of Rs.1,00,000/- in terms of the Circular dated 23rd April, 2010.

Admittedly, the said Circular was not applicable to Anganwari Workers. It applies to the casual workers under the State.

The petitioner submits that since the Government Circular dated 30th September, had extended similar benefits of Rs.3,00,000/- to casual workers under the State also to Anganwari Workers retiring at the age of 65 years after 30th September, 2020, the petitioner should be given the same. Admittedly, the said Circular is not under the challenge.

Since the petitioners have retired prior to 30th September, 2020, no relief can be granted them. The petitioners are outside the cut off date under the aforesaid circular.

In view of the above, the instant writ petition is dismissed.

The aforesaid order shall not prevent the State from taking any further decision to include the petitioners or persons similarly situated as the petitioners for any such benefit as granted under the aforesaid Circular dated 30th September, 2020.

No order as to costs.
