Petitioner approaches this Court alleging that on receipt of a phone, an individual who introduced himself as a staff of Axis Bank, Krishnanagar Branch Nadia, he furnished information consequent to which Rs.6,00,000/- was debited fraudulently without his knowledge. Subsequently again a sum of Rs.69,000/- was withdrawn by using the debit card of the petitioner. Both the transactions were fraudulently done and to that effect information was furnished to the Inspector-in-charge, Cyber Crime Police Station, Berhampore, Murshidabad which was dated 23.11.2023. The Police authorities inspite of receipt of such information relating to a cognizable offence did not take any steps.

Ansar Mandal, learned Additional Government Pleader has submitted a report. Report reflects that the Police authorities have already registered Cyber Crime Case No. 1 of 2024 dated 9.2.2024 under the relevant provisions of the Indian Penal Code and the Information Technology Act to that effect communications are being sent to all the authorities and the mobile location of the phone number are being also traced.

Having regard to the fact that the petitioner approached at the stage when it was alleged that no steps have been taken by the Police authorities and the report submitted by the Police authorities reflects that the purpose for which the writ petition was preferred has been sub-served. Police authorities are directed to take the investigation of the case to its logical conclusion by exhausting their efforts. With the above observations W.P.A. 2518 of 2024 is disposed of.

The reports submitted be kept with the record. A copy of the report be handed over to the learned advocate appearing for the petitioner.

All concerned parties shall act on the serve copy of this order duly downloaded from the official website of this Court.
