The State of West Bengal Mr. Anwar Hossain Ms. Manisha Sharma .....For the State The present revisional application has been preferred challenging the order passed by the Learned Additional Chief Judicial Magistrate, Sealdah in connection with Tapsia Police Station Case No.97 of 2012 dated 23.07.2012.
Mr. Anwar Hossain, learned advocate appears on behalf of the State.
The grievance of the petitioner relates to the whole of the proceedings, which was continuing pursuant to the F.I.R. being registered. No information has been furnished before this Court regarding the conclusion of the investigation by the Investigating Agency. The records of the revisional application reflects that by an order dated 14.01.2013 a Co-ordinate Bench of this Court was pleased to stay the proceedings so far as the present petitioner is concerned. Having regard to the fact that no persuasion has been made by the petitioner, thereafter before this Court. I am of the opinion that the revisional application should be disposed of with liberty to the petitioner to approach before the Learned Magistrate
after the police report under Section 173 of the Code of Criminal Procedure is filed before the said Court.
No interference is called for, so far as the merits of the case is concerned, Accordingly, CRR 78 of 2013 is dismissed.
All pending connected applications, if any, are consequently disposed of.
Interim order, if any, is hereby vacated.
