Learned Advocate appearing for the petitioner submits that on a number of occasions application under Section 173(8) of the Code of Criminal Procedure has been preferred by the de facto complainant which were considered and rejected. A revisional application has been preferred which is pending before the learned Fast Track, 3rd Court, Barrackpore being Criminal Revision no. 585 of 2023.

Learned Advocate submits that the genesis of the case relate to Dumdum Police Station case no. 253 of 2021 which is pending before the learned Judicial Magistrate, 5th Court, Barrackpore and the learned trial Court has already framed charges and fixed date for evidence.

Mr. Roy, learned Public Prosecutor appears on behalf of the State and submits that the revisional Court is in siesin of the issue which has been canvassed there.

Having considered that Criminal Revision no. 585 of 2023 is pending before the learned Fast Track, 3rd Court, Barrackpore and the next date has been fixed by the learned Revisional Court on 6th March, 2024, I direct the learned Revisional Court to dispose of the revisional application by 30th March, 2024. The learned Revisional Court will be at liberty to fix as many numbers of dates as it deems fit and proper but should not stretch the timeline which has been fixed by this Court.

With the aforesaid observations CRR 478 of 2024 is disposed of.

Pending applications, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
