Affidavit of service filed in Court today is taken on record.

2.The instant appeal is directed against judgment and order dated 27th January, 2026 passed by a Single Bench of this Court where the writ petitioner has challenged a condition of tender which requires bidders to have experience of a particular category within the last 3 years of the date of submission of bids. The Single Bench refused to entertain challenge to the said condition in the NIT. However, one incorrect condition left blank was directed to be filled up by the respondents through a corrigendum to the NIT.

Mr. Amal Kr. Sen, learned Additional Advocate General submits that since it was not possible to issue corrigendum as the last date of submission of bids had expired, the respondent authorities have decided to cancel the entire NIT and issue afresh.

4.It is made clear that the respondents shall be entitled to fix any new condition or change existing eligibility criteria, if they so deemed fit, in the new NIT that may be issued by them.

In view of the submissions of the State, nothing further remains to be adjudicated in the instant appeal. 6.

Hence, MAT 186 of 2026 is, therefore, disposed of.

Consequently, CAN 1 of 2026 shall also stand disposed of.

8.The instructions of Mr. Sen, issued by his clients, are taken on record.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
