Petitioner complains that he is a ration dealer, whose business materials amounting to Rs.1,50,000/- were thrown away by the private respondents, petitioner was assaulted, abused, threatened because of the petitioner refusing to pay any illegal money as claimed by the private respondents.

It has further been alleged by the learned advocate for the petitioner that in spite of reporting to the police station no steps have been taken.

Learned advocate for the State has submitted a report. Report reflects that Canning P.S. Case No.84 dated 03/02/2024 has been registered under

Sections 447/323/427/384/506/34 of IPC and 3 PDPP Act.

Learned advocate represents the respondents and opposing the contention submits that the respondents have been falsely implicated by way of wild allegations.

Having considered the purpose for which the writ petition has been preferred and the same being addressed by the State. Further pendency of the writ petition is unwarranted. The investigation agency is directed to take the investigation to its logical conclusion if till date the report under Section 173 has not been filed before the jurisdictional Court. Report so submitted be kept with the record. A copy of the report be handed over to the learned advocate appearing on behalf of the petitioner. With the aforesaid observations, the writ petition being WPA 2541 of 2024 is disposed of. There shall be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
