In Re: An Application under Section 401 read with Section 482 of the Code of Criminal Procedure.

The present revisional application was preferred challenging the proceedings of C.R. No. 6737/2014 pending before the learned Additional Chief Judicial Magistrate, Lalbagh, Murshidabad.

Having regard to the contention in this revisional application, I am of the opinion that the same is based on mixed question of facts and law which cannot be adjudicated without the proceeding progressing for trial. Accordingly, the revisional application being CRR 69 of 2016 is dismissed.

Interim order, if any, is hereby vacated.

All pending connected applications, if any, are consequently disposed of.
