This revisional application has been filed for expeditious disposal of the Mat Suit No. 35 of 2017, pending before the learned Additional District Judge, 2nd Court, Durgapur.

Order sheets reveal that the issues have been framed on January 21, 2020 and the said suit has been fixed for peremptory hearing. Thereafter, the suit has been adjourned due to the pandemic situation.

Having considered the submissions made by the learned advocate for the petitioner/husband as also the records, this court is of the opinion that justice would be subserved if the Mat Suit No. 35 of 2017 is disposed of expeditiously within a period of six months from the next date fixed upon giving opportunity of hearing to all the parties to contest the same.

It is made clear that this order will not be operative if the husband fails to pay the maintenance pendente lite as directed in the matter.

This court has not gone into the merits of the claims of the petitioner and the learned court below will proceed independently and in accordance with law.

Petitioner is directed to serve a copy of the revisional application along with the server copy of this order upon the opposite party and/or her learned advocate appearing in the court below. The revisional application is disposed of. There shall be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties as expeditiously as possible subject to compliance of all usual formalities.
