Sher Mahammad Sk @ Sariful Sk v. State Of West Bengal
07.02.2023.
23.
Ct.No.28 as (Rejected) C.R.M. (DB) 463 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Ketugram P.S. Case No.262 of 2022 dated 05.06.2022 under Sections 498(A)/406/120B/326/307/34 of the Indian Penal Code. In the matter of : Sher Mahammad Sk. @ Sariful Sk. ... Petitioner.
Mr. Arindam Roy.
...for the Petitioner.
Mr. Swapan Banerjee, Mr. Suman De.
...for the State.
Petitioner is in custody for 246 days. Co-accuseds are on bail. He prays for bail.
Learned Advocate for the State opposes the bail prayer. We have considered the materials on record. Petitioner had chopped the hand of his wife. Part of the hand was amputated. Date has been fixed for consideration of charge. In view of the gravity of the offence and as date has been fixed for consideration of charge, we are not inclined to grant bail to the petitioner.
Accordingly, the prayer for bail of the petitioner is rejected.
Trial court is directed to consider the issue of framing charge at the earliest and in the event charge is framed to take the proceeding to its logical conclusion without granting any unnecessary adjournment to either of the parties. (Ajay Kumar Gupta,J.) (Joymalya Bagchi, J.)
