This revisional application has been filed by the defendant no. 11 who is the respondent no. 1 in Misc. Appeal No. 234 of 2018, pending before the learned Additional District Judge, 10th Court, Alipore, South 24 Parganas, arising out of Title Suit No. 839 of 2018.
It is the contention of the petitioner that the Misc. Appeal has been transferred to the court of the learned Additional District Judge, 10th Court, Alipore, South 24 Parganas from the court of the learned Additional District Judge, 15th Court at Alipore. The petitioner submitted that the records have not yet arrived as a result of which the pending applications have not been disposed of.
Under such circumstances, this revisional application is disposed of with a direction upon the learned court below to take steps for transmission of the records from the earlier court so that the pending applications may be disposed of expeditiously, i.e.
within a period of two months from the next date fixed upon affording opportunity to all the concerned contesting parties to contest the same.
This court has not gone into the merits of the claims of the petitioner and the learned court below will proceed independently and in accordance with law.
Petitioner is directed to serve a copy of the revisional application along with the server copy of this order upon the opposite parties 1 to 25 through their learned advocate appearing in the court below. Service upon the opposite parties 26 to 36 be effected also through their learned advocate appearing in the court below.
The revisional application is disposed of. There shall be no order as to costs.
Urgent photostat certified copy of this order, if applied for, be given to the parties as expeditiously as possible subject to compliance of all usual formalities.
