06.05.2022 S/L No.10 KS C.R.R. 78 of 2015 Habib Sk.

-Vs.- Shehanaj Khatun & Anr.

The revisional application is listed today for hearing. None appears on behalf of the petitioner and for the opposite parties. The petitioner filed this revisional application under Section 401 and Section 482 of the Code of Criminal Procedure assailing the order dated 20.12.2014 passed by Learned Sessions Judge, Hooghly in Criminal Motion No.500089 of 2014 arising out of Misc. Case No.122 of 2014 filed by the opposite party/wife under Section 125 of the Code of Criminal Procedure. The petitioner herein, as the husband has challenged the impugned order whereby the Learned Sessions Judge, Hooghly modified the quantum of maintenance granted by the Learned Judicial Magistrate, reducing it to Rs.5,000/- in place of Rs.5,500/- to be paid by the husband from the date of impugned order as directed by the Learned Magistrate.

Administrative Notice was issued to the petitioner through Learned Registrar Administration (L & OM). As per report the notice issued to the petitioner has been returned un-served with a report that he has left the address without instruction. Regarding service of notice upon the opposite party/wife, the same has been duly served upon her. The report is taken on record.

Considered the materials on record and the impugned order, I find no illegality or irregularity in the order passed by Learned Sessions Judge in the

Criminal revision. I therefore find no reason to interfere with the order, as such, the revisional application is dismissed for default and is disposed of. Let a copy of this order be sent to the Court of Learned Sessions Judge, Hooghly for information.
