Learned advocate appearing for the petitioner submits that the petitioner has been implicated on the accusation of alleged recovery of 43 kgs of ganja. So far as the issue of the petitioner being connected with the alleged offence is on the basis of CCTV footage. There is no strong foundation so far as the complicity of the present petitioner is concerned.

Learned advocate for the State opposes the prayer for bail and submits that the chain of events which has been collected by the prosecution in course of investigation provides a clinching link of the present petitioner to the alleged offence. Since the case is about to commence, I am of the view that at this stage further deliberation on the facts is unwarranted

but having considered the totality of the circumstances and the manner in which the contraband was transshipped, I am not inclined to release the petitioner on bail.

Accordingly, CRM(NDPS)247 of 2026 is dismissed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
