Learned advocate appearing for the petitioner is aggrieved by the progress of C. Case No. 476 of 2017 pending before learned Judicial Magistrate, 1st Court, Barrackpore. Learned advocate submits that more than six years have passed, but till date there has been no substantial progress in the case and even evidence of first prosecution witness has not been completed.

Records reflect that cross-examination of the first prosecution witness is continuing and the next date is fixed on 01.03.2024. Having considered the manner in which the case is progressing and the methods adopted by the accused for delaying the trial, I direct the learned Judicial Magistrate, 1st Court, Barrackpore to fix at least one date in every 45 days so that trial of the case can be taken to its logical conclusion within a reasonable period of time. In case the accused in a designed manner protracts the trial of the case, learned Magistrate would be at liberty to impose exemplary costs.

With the aforesaid observations, the revisional application being CRR 479 of 2024 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
