IN THE HIGH COURT AT CALCUTTA

Item No.7 CRIMINAL REVISIONAL JURISDICTION Ct.No.34 dc.

C.R.R. 241 of 2012 (Via Video Conference) Manav Chhawchharia & Anr.

versus The State of West Bengal & Anr.

In Re: An Application under Section 482 of the Code of Criminal Procedure, 1973.

Mr. Arijit Ganguly, Mr. Sandip Chakraborty ... For the State.

The present revisional application has been preferred challenging the charge-sheet submitted in connection with Park Street P.S. Case No. 210 dated 20.08.2006. At the time of admission of the revisional application on 27.02.2012, there was an interim order in respect of the proceedings pending before the learned Metropolitan Magistrate, 9th Court, Calcutta for a period of twelve weeks. The said interim order was never extended thereafter.

Having regard to the fact that the present stage of the proceeding has not been apprised before this Court and the petitioners approached this Court at the stage when the charge-sheet was submitted, I am of the view that the revisional application is a premature one. The petitioners are granted liberty to take up the points before the learned trial court in course of trial or at the stage of final arguments of the case.

With the aforesaid observations, CRR 241 of 2012 is dismissed.

All pending applications, if any, are consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
