29.11.2021 FMAT 90 of 2017 with I.A No. CAN 1 of 2017 (Old No. 878 of 2017) CAN 2 of 2017 (Old No. 879 of 2017) Pappu Sah & Ors.

Vs.

Lakshmi Narayan Das & Ors.

Ct-08 ar The appellants are not represented, nor any accommodation is prayed for on behalf of the appellants even in the second call. Even on the last occasion the appellants were not represented.

We have called for the status report of the suit. Let the same be kept with the record. We have considered the fact that the ad interim order of injunction was extended from time to time, as it revealed from the status report.

Accordingly, the learned trial court is directed to dispose the hearing of the suit as early as possible, preferably within one year from the date of communication of this order, without granting any adjournment to either of the parties, unless it is unavoidable.

In view of the above, the appeal has now become irrelevant because of the subsequent development of the suit. Accordingly, the appeal and the connected applications stand dismissed. The Registrar Administration (L & OM) is directed to communicate this order to the learned Judge, 13th Bench, City Civil Court, Calcutta.
