1. It is submitted by the applicant appearing in person that a preliminary decree has been passed and the matter has been fixed after 90 days for passing a final decree.

2. This Court notes that the order passed by the Court below is in accordance with the procedure prescribed under the Code of Civil Procedure, 1908. In so far as the observations of the Court is concerned that the partition suit has been disposed of, the same must be deemed as erroneous as the partition suit is not disposed of until passing of final decree.

3. In view of the above, nothing further remains to be decided in this contempt application. The contempt application shall stand disposed of.

4. There will be no order as to costs.

5. All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
