It has been complained that the petitioner and his wife have been thrown away from their own residence and in order to pressurize the petitioner, his wife was assaulted physically and hurled with abusing languages. The petitioner complained on 13.01.2025 but no steps were taken by the police authorities.
Learned advocate for the State has submitted a report which reflects that Ausgram Police Station case no. 59 of 2025 dated 08.02.2025 has been registered for investigation under the relevant provisions of the BNS, 2023. The investigation of the case is under process. Prima facie it reflects from the report that the petitioner had taken loan
and is subject to pressure by or at the hands of the different persons.
Be that as it may, the police authorities would ensure that the petitioner and/or his family member are not physically harassed by the creditors. To that effect the police authorities obviously would act if there are orders from the court in favour of the creditors. The life of the petitioner be not put at stake at the hands of the creditors. It is reiterated that in case the creditors are armed with any order of any court of law that will obviously not prevent the police authorities to respect and obey the court of law.
With the above observation WPA 2750 of 2025 is disposed of.
Report so submitted be kept with the record.
A copy of the report be handed over to the learned advocate appearing for the petitioner. Parties are to act on the server copy of this order duly downloaded from the official website of this Hon'ble High Court.
