(NDPS) 194 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Nowda Police Station Case No. 135 of 2021 dated 14.06.2021 under Sections 22(c)/29 of the Narcotic Drugs and Psychotropic Substances Act.

...... petitioners Ms. Rabia Khatoon ....for the petitioners Mr. Ranadeb Sengupta ....for the State Considering the fact that the commercial quantity of narcotic was seized from the joint possession of the petitioners, we are of the view that the petitioners are unable to overcome the restrictions under Section 37 of the NDPS Act, 1985. Consequently, we are unable to grant bail to the petitioner.
Accordingly, prayer for bail of the petitioner is rejected and the application being CRM (NDPS) 194 of 2022 is dismissed.
It is expected that the police will file the chemical examination report before the Jurisdictional Court as expeditiously as possible.
