Learned advocate for the petitioner submits that the petitioner is in custody from November, 2019 and till date, there has been no progress in the case. As such, he may be released on bail. The petitioner has been shifted from Dum Dum Correctional Home to Medinipur Jail and he has not been produced before the learned Special Judge, 6th Court, Barasat, North 24 Parganas on the date specified by the Court for the purpose of the case.

Learned advocate for the State opposes the prayer for bail of the petitioner. Learned advocate further submits that earlier the petitioner's prayer for bail was rejected on 7th December, 2020.

We have perused the case diary and after going through the materials on record, the petitioner is not entitled to be released on bail.

Since the petitioner is not being produced before the learned Special Judge on the date so fixed, the I.G. Prisons, West Bengal is directed to ensure the production of the accused on the specified date when the learned Additional District & Sessions Judge, 6th Court, Barasat, North 24 Parganas is pleased to take up the matter.

The State is directed to communicate this order to the office of the I.G. Prisons immediately. With the aforesaid observations, the CRM 1186 of 2021 is rejected.
