For the State The petitioner prays for implementation of the sanction water plan at premises no. 55/3, B.L No. 14, Ward No. 13 under Bhatpara Municipality.
In response to the application made by the petitioner for obtaining the water connection the Bhatpara Municipality approved the plan and issued quotation and directed the petitioner to deposit the charges for the same.
The petitioner has already deposited the money long back on 13th August, 2019.
The petitioner complains that even though the Municipality is agreeable to effect the water connection, the private respondent is standing in the way.
A copy of the proposed water connection plan at the aforesaid premises has been annexed to the writ petition.
It appears that the water connection is being made by the Municipality through a 6 feet wide common passage. The petitioner submits that the passage is a common one and the petitioner
is entitled to use the same for underground water connection line.
None appears on behalf of the private respondent to oppose this application, despite service.
Affidavit of service filed in Court is retained with the record.
Learned advocate representing the Municipality submits that the officials of the Municipality inspected the aforesaid premises in question for the purpose of giving water connection but they were restrained by the private respondent from doing so.
As it appears that the Municipality has already approved the water connection plan and the petitioner has paid the amount directed by the Municipality long back, the writ petition is disposed of by directing the Municipality to give water connection to the petitioner within ten days from the date of communication of this order.
The Inspector-in-Charge of Jagaddal Police Station shall ensure necessary police protection at the time when the Municipality will give water connection in the said premises.
WPA 1839 of 2020 stands disposed of.
Urgent photostat certified copy of this order, if applied for, be given to the parties after completion of all legal formalities.
