The affidavit of service filed by the petitioners is taken on record.
The allegation in this public interest petition is in respect of encroachment on the vacant part of both sides of Panskura to Durgachak Highway by some unauthorised persons.
Learned counsel appearing for the State has pointed out that though the representation dated 04.05.2022, annexure "P-1" was submitted by the petitioners to the respondent no.3 i.e. Executive Engineer, Public Works (Road) Directorate, but sufficient particulars of encroachment have not been disclosed in the said representation. He submits that if proper representation with full particulars is submitted, then the needful be done by the concerned respondents. Hence, we dispose of the present writ petition permitting the petitioners to submit fresh
representation before the respondent no.3 containing the full particulars of alleged encroachment and on receipt of the said representation, the respondent no.3 will do the needful as required by law after giving an opportunity of hearing to all the concerned parties as expeditiously as possible preferably within a period of three months from the date of receipt of the said representation.
The petition is, accordingly, disposed of.
