None appears on behalf of the petitioner in Court today when the matter is called on.

On July 9, 2007 when the revisional application was admitted and the petitioner was directed to serve upon the opposite parties and file affidavit of service within a period of three weeks. No such affidavit of service is on record.

Furthermore, the Court had passed an order of stay in all further proceedings in connection with the Case No.963 of 2003 for a period of four weeks.

It appears from the records that this order of stay has expired after four weeks and no application has ever been filed for the purpose of extending the said order of stay. Furthermore, no affidavit of service has been filed in this Court.

In light of the same, I am of the view that the petitioner is no longer interested in pursuing this lis. Accordingly, the revisional application is dismissed for default. Interim order, if any, shall stand vacated. The concerned department is directed to communicate the order passed in Court today to the Court below. The department shall ensure that acknowledgement of receipt of their communication is received. Report of compliance to be placed before this Court after three weeks. (Shekhar B. Saraf, J.)
