Petitioner approached this court as the representation dated 20.01.2023 addressed to the Officer-in-charge, Bhagwanpur Police Station did not yield any result. From the representations so made on 20.01.2023 I find that there was a dispute relating to construction of steps/stairs at the house. Having regard to the nature of the dispute complained of I am of the view that the same is a civil dispute.

As none appears on behalf of the State Mr.

Kartik Chandra Kapas, learned advocate who ordinarily appears for the State is directed to represent the State. His appearance may be regularised by the concerned authorities.

Taking into consideration the subject matter which has been referred to is a dispute arising out of certain constructions between the

petitioner and the private respondents, I am of the view that if there is any violation of law and order, police authorities would interfere and try to prevent any breach of the peace and/or tranquility. So far as the other issues are concerned, the civil court would be appropriate forum for dealing with the same. With the aforesaid observations WPA 2582 of 2023 is disposed of.
