Kausik (Rejected) CRM (R) 19 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Tamluk Police Station Case No. 959 of 2024 dated 30.10.2024 under Sections 318(4)/317(4)/336(3)/338/339/340(2) with section 3(5) and section 61(2) of BNS, 2023.

Learned advocate appearing for the petitioner submits that petitioner is innocent of the charges and had been running SBI Kiosk. Petitioner was implicated falsely and is in custody for more than 1 year and 3 months.

Learned advocate for the State opposes the prayer for bail and submits that earlier in CRM(R) 52 of 2025 there was a specific direction that vital witnesses be concluded by 31.03.2026.

Learned advocate for the State submits that two witnesses have already been examined, further witnesses are being examined. All efforts are being exerted so that the trial

progresses and the dates have already been fixed by the learned Trial Court for evidence of the relevant /vital witnesses. Having considered the stage of the case, I am not inclined to release the petitioner on bail at this stage. Accordingly, the prayer for bail of the petitioner in CRM(R) 19 of 2026 is dismissed.

Report submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
