It appears that pursuant to a direction of this Court passed on 21st July, 2006 in W. P. No. 22474(W) of 2005, the petitioners lodged a complaint with the Lake Police Station in respect of a fraudulent withdrawal of money from their bank account.

At the request of the Lake Police Station and particularly the Sub Inspector posted thereat, documents appear to have been submitted by the petitioners on 9th August, 2007. Curiously, by letter of the same day, documents are also forwarded to one Mr. S. Sen, S.I. of Tollygunge Police Station. It is submitted from the bar by Mr. Chaturvedi that the petitioners were in regular touch with Mr. Sen and were supplying documents to him. The letter annexed to the writ petition of 9th August, 2007 does not bear any receipt.

The matter was forgotten by the petitioners since after 2009 when the matter appeared before a single bench of this Court. The writ petition was thereafter listed as old matter on 17th August, 2021 after a lapse of 14 years. During this period of 14 years, it does not appear that the petitioners made any effort to press the writ petition before this Court.

Be that as it may, Rabindra Sarobar Police Station shall take up investigation into the complaint of the petitioners dated 7th September, 2006 being annexure P-13 to the writ petition register F. I. R. The petitioners shall supply whatever documents available with them to the Rabindra Sarobar Police Station. It is expected that the investigation of the matter is completed as expeditiously as possible preferably within a period of one month from the date of communication of a copy of this order and final report be submitted before the Jurisdictional Magistrate.

With the aforesaid observations, the writ petition is disposed of.

There will be no order as to costs.
