None appears on behalf of the petitioner in Court today when the matter is called on.
On February 1, 2007 when the revisional application was admitted and the petitioner was directed to serve upon the opposite parties and file affidavit of service within a period of three weeks. No such affidavit of service is on record.
Furthermore, the Court had passed an order of stay in all further proceedings in connection with the Misc. Case No.108 of 2003 and Misc. Execution Case No.56 (IV) of 2006 for a period of four weeks and thereafter extended for a period of two months on March 23, 2007. Since then no steps have been taken by the petitioner. No affidavit of service has been filed in this Court and neither any application for extension of interim order is made.
In light of the same, I am of the view that the petitioner is no longer interested in pursuing this lis. Accordingly, the revisional application is dismissed for default. Interim order, if any, shall stand vacated. The concerned department is directed to communicate the order passed in Court today to the Court below. The department shall ensure that acknowledgement of receipt of their communication is received. Report of compliance to be placed before this Court after three weeks. (Shekhar B. Saraf, J.)
