2. Ms. Roy Choudhury, learned Advocate appearing for the respondent no. 1, Bank, submits that the writ petition, challenging the sale notice dated January 22, 2021, has become infructuous in view of the fact that such sale notice had been subsequently withdrawn.

3. She further submits that a fresh sale notice of 2025 has already been issued by the Bank, which was challenged before the Debt Recovery Tribunal and is pending as such.

4. Thus, the writ petition has become infructuous and is dismissed.

5. There shall, however, be no order as to costs.

6. Urgent photostat certified copy of this order, if applied for, be supplied to the parties on usual undertaking.
