A direction to secure expeditious disposal of pending execution case has been sought for, upon resorting to Article 227 of the Constitution of India. In view of the submission disclosed by the learned advocate for the petitioner, no appeal has been preferred impugning the judgment and decree passed in this case by the Jdr/opposite party. In view of the nature of the order proposed to be made, service of notice upon the opposite party is considered to be not necessary. Service is thus, dispensed with.
Learned Civil Judge (Junior Division), 1st Court, Barasat in connection with Title Execution Case No. 08 of 2021 arising out of Title suit No. 1076 of 2016, is directed to ensure expeditious disposal of the pending execution case in accordance with the provisions of the law, but without granting unnecessary adjournments, unless it is extremely unavoidable.
With this direction and observation, the revisional application stands disposed of.
There shall be no order as to costs.
